RULES OF PARTICIPATION IN THE PRIZE COMPETITION

"Marodi - The Legend of the Holiday Table!"

Article 1: General Provisions

1.1. The organiser of the prize competition "Marodi - The Legend of the Holiday Table!" (hereinafter: Prize Competition) is Marodi d.o.o., Gospodarska ul. 5, 40305 Nedelišće, OIB: 28972867079 (hereinafter: Organiser).

1.2. The Prize Competition is not a game of chance within the meaning of Articles 2 and 3 of the Rules on Organising Prize Games (Narodne novine 8/2010) in relation to Article 69 of the Games of Chance Act (Narodne novine 87/2009, 35/2013, 158/2013, 41/2014, 143/2014).

1.3. These rules of the prize competition (hereinafter: Rules) will be published and accessible via a link contained in the invitation to participate in the Prize Competition published on the official Marodi Facebook profile (facebook.com/maroditjestenina), in the description of the official Marodi Instagram profile (https://www.instagram.com/marodihr/), and on the website (www.marodi.com) (hereinafter collectively: Profile).

1.4. By entering the Prize Competition, the Participant (as defined in Article 3, paragraph 3.1 of these Rules) fully accepts these Rules.

Article 2: Duration and Purpose of the Prize Competition

2.1. The Prize Competition is conducted for the purpose of promoting the Organiser's products.

2.2. The Prize Competition begins on 15 December 2023 at 4:00 p.m. and ends on 19 December 2023 at 11:59 p.m.

Article 3: Right of Participation

3.1. The right to participate in the Prize Competition is granted to all adult individuals residing in the Republic of Croatia who have active profiles on social networks Facebook (www.facebook.com) or Instagram (www.instagram.com) (hereinafter: Participant/s).

3.2. Individuals involved in the organisation of the Prize Competition, as well as employees of the Organiser and their immediate family members (parents, spouses, children, sisters, and brothers), are not allowed to participate.

Article 4: Method of Participation in the Prize Competition

4.1. Participants can enter the Prize Competition by commenting on the invitation post on the Organiser’s Profile from 15 December 2023 at 4:00 p.m. until 19 December 2023 at 11:59 p.m., sharing (in writing or through a photo/video) why they are the "legend of the holiday table" (hereinafter: Comment/s). Each Participant may submit only one Comment. A total of five most creative responses on Instagram and Facebook will be awarded with:

Prize: A PuellaLu apron and a Marodi package with 7 Marodi products (Tagliatelle Verdi, Fettuccine, Mafaldine Corte, Ribana Kašica with Carrot, Thin Noodles with Carrot, Wavy Noodles, Spaghetti)

4.2. All entries meeting the conditions of the Prize Competition and submitted within the competition period will be included in the selection process for the Prize Competition winners.

4.3. Comments will not be considered for selection as a Winner (as defined in Article 5, paragraph 5.3 of these Rules) if:

• The Participant does not state why they are the legend of the holiday table.
• The Comment contains inappropriate or offensive words and/or expressions.
• The Comment allegedly infringes the rights of third parties as specified in paragraph 4.7 of this Article.

4.4. Incorrect or incomplete entries are invalid and do not entitle the Participant to any prize; they are considered a breach of these Rules, and the Organiser reserves the right to disqualify such Participants from the competition at any time.

4.5. The Organiser has the right, at its discretion, to remove any Comment and disqualify any Participant, including a Winner, if they act contrary to applicable legal regulations, these Rules, or generally accepted ethical norms or damage the Organiser's reputation or interests. This includes suspected fraudulent behaviour or if the Organiser receives a complaint or request from a third party regarding any infringement of their rights due to a Participant’s Comment.

4.6. The Organiser is not liable for ordinary negligence.

4.7. If a third party files a claim with the Organiser alleging that a specific Comment infringes their rights, the Participant shall indemnify the Organiser for any damages incurred, including penalties, compensation awarded, and/or legal costs.

Article 5: Prize Fund, Winner Selection, and Prize

5.1. The total prize fund is valued at 238.65 EUR.

5.2. Winners will be selected by a panel of three Organiser’s employees, who will choose five (5) of the most creative entries to receive the Prize.

5.3. At the end of the Prize Competition, the Organiser will select a total of five Comments from Facebook and Instagram that best describe why a certain person is the legend of the holiday table (hereinafter: Winner/s).

5.4. Each Winner will receive one Marodi package (hereinafter: Prize/s).

5.5. Each Winner is eligible to receive only one Prize.

5.6. The Winner is not entitled to request another prize or a Prize in a larger quantity than provided by these Rules. The Prize is non-transferable and cannot be exchanged for cash.

Article 6: Prize Notification and Collection

6.1. The Organiser will notify the Winner by publicly replying to the winning Comment within five (5) days of the end of the Prize Competition, inviting the Winner to contact the Organiser within two (2) days via the official Marodi Facebook inbox or Instagram DM, after which the Organiser will provide all necessary details for Prize collection. Otherwise, it will be assumed that the Winner has forfeited the Prize.

6.2. The Prize will be delivered to the address provided by the Winner. The Winner must confirm their identity by presenting a valid photo ID upon Prize collection.

6.3. The Organiser’s obligations towards the Winner cease upon Prize handover.

Article 7: Intellectual Property Rights

7.1. The content and all parts of the Organiser’s website, as well as the Organiser's Facebook and Instagram profiles (hereinafter: Materials), may be protected by copyright or other intellectual property rights. All such rights are reserved by the Organiser and any other right holders. The Materials are available for personal, non-commercial viewing, but downloading, copying, publishing, distributing, or any other use for commercial purposes, in whole or in part, is not permitted without prior consent from the Organiser.

7.2. By submitting their Comment, each Participant guarantees that they have all rights to the Comment, including copyright, and that they are authorised to grant these rights to the Organiser. Each Participant retains all rights to their Comment(s) submitted to the Prize Competition. By submitting their Comment, the Participant grants the Organiser a non-exclusive, unrestricted right to use the Comment solely for the purposes of organising, conducting, and executing this Prize Competition.

Article 8: Processing and Protection of Personal Data

8.1. The Organiser is the data controller of the Participants' and Winners' Personal Data (as defined in paragraph 8.2 of this Article). The Organiser has appointed a Data Protection Officer who can be contacted at marodi@marodi.hr.

8.2. The Organiser processes the following personal data (hereinafter: Personal Data) for the purposes of organising, conducting, and executing the Prize Competition (hereinafter: Purpose/s):

(a) For Participants: name and surname or nickname used for their Facebook/Instagram profile from which the Comment was submitted – for the Purpose of participating in the Prize Competition.

(b) For Winners: in addition to the data in sub-item (c) of this paragraph, name, surname, address, and mobile phone number – for the Purpose of Prize collection; and

(c) For Winners: name and surname or nickname used for their Facebook/Instagram profile from which the Comment was submitted – for the Purpose of public announcement and transparency of the Prize Competition.

8.3. The legal basis for processing Personal Data in paragraph 8.2 (excluding data in sub-item (c)) is the Organiser’s obligation toward the Participants and Winners under this Prize Competition, in line with Article 6, paragraph 1, point (b) of the General Data Protection Regulation (EU) 2016/679 (GDPR). This provision of Personal Data is obligatory as it is necessary for participation. The legal basis for processing Personal Data in paragraph 8.2, sub-item (c), is the Organiser’s legitimate interest in ensuring Prize Competition transparency.

8.4. Personal Data of Participants and Winners may be shared with:

• The Organiser's affiliated companies, which may be located in third countries (non-EU/EEA or Switzerland) (the Organiser will take all reasonable measures to ensure adequate data protection).
• Data processors (e.g., advertising/marketing agencies, couriers).
• Competent authorities as required by law.

8.5. The Organiser will process the Personal Data of Participants and Winners for the Purpose/s defined in paragraph 8.2 and retain it for up to ten (10) business days after the Prize Competition ends. Organiser may keep the data in records for up to six (6) years unless otherwise required by law.

8.6. Participants’ and Winners’ rights regarding Personal Data include:

(a) Right to access Personal Data. (b) Right to correct inaccurate Personal Data. (c) Right to delete Personal Data in specific cases. (d) Right to restrict processing. (e) Right to lodge a complaint regarding Personal Data with the Croatian Personal Data Protection Agency, Selska cesta 136, Zagreb (www.azop.hr).

8.7. The Organiser securely processes Personal Data following applicable legal standards.

Article 9: Cancellation or Suspension of the Prize Competition

9.1. In the event of force majeure, the Organiser may cancel or suspend the Prize Competition and will notify all Participants on the Profile and on its website (https://marodi.com/) as soon as possible.

9.2. The Organiser shall not be liable for any damages arising from such cancellation or suspension.

Article 10: Dispute Resolution

10.1. The Organiser’s decision on all issues related to the Prize Competition is final and binding on all Participants.

10.2. Any disputes shall be resolved by the competent court in Zagreb.
