RULES OF PARTICIPATION IN THE PRIZE COMPETITION
“Marodi - Fiery Plate”
Article 1: General Provisions
1.1. The organiser of the prize competition "Marodi - Fiery Plate" (hereinafter: Prize Competition) is Marodi d.o.o., Gospodarska ul. 5, 40305 Nedelišće, OIB: 28972867079 (hereinafter: Organiser).
1.2. The Prize Competition is not a prize game within the meaning of Articles 2 and 3 of the Rules on Organising Prize Games (Narodne novine 8/2010) in relation to Article 69 of the Games of Chance Act (Narodne novine 87/2009, 35/2013, 158/2013, 41/2014, 143/2014).
1.3. These Rules of the Prize Competition (hereinafter: Rules) will be published and available via a link contained in the call for participation in the Prize Competition posted on the official Marodi profile on Facebook (facebook.com/maroditjestenina), in the profile description of the official Marodi Instagram (https://www.instagram.com/marodihr/), and on the website (www.marodi.com) (hereinafter collectively: Profile).
1.4. By entering the Prize Competition, the Participant (as defined in Article 3, paragraph 3.1. of these Rules) fully accepts these Rules.
Article 2: Duration and Purpose of the Prize Competition
2.1. The Prize Competition is organised for the promotion of the Organiser's products.
2.2. The Prize Competition begins on 19 June 2024 at 12:00 p.m. and runs until 30 June 2024 at 11:59 p.m.
Article 3: Right of Participation
3.1. The right to participate in the Prize Competition is granted to all adult individuals residing in the Republic of Croatia who have active profiles on social networks Facebook (www.facebook.com) or Instagram (www.instagram.com) (hereinafter: Participant/s).
3.2. Individuals involved in the organisation of the Prize Competition, as well as employees of the Organiser and their immediate family members (parents, spouses, children, sisters, and brothers), are not allowed to participate in the Prize Competition.
Article 4: Method of Participation in the Prize Competition
4.1. Participants can enter the Prize Competition by posting a creative recipe for a pasta dish that reminds them of their favourite Croatian national team footballer (hereinafter: Comment/s) in the comments of the Prize Competition invitation post on the Organiser’s Profile from 19 June 2024 at 12:00 p.m. until 30 June 2024 at 11:59 p.m. Each Participant may submit only one Comment. A total of three most creative responses on Instagram and Facebook will be awarded with:

4.2. All entries that meet the conditions of the Prize Competition and are submitted within the Competition period will be included in the process of selecting the Prize Competition winners.
4.3. Comments will not be considered for selection as a Winner (as defined in Article 5, paragraph 5.3. of these Rules) if:
- The Participant does not write a creative recipe for a pasta dish that reminds them of their favourite Croatian national team footballer.
- It contains profane or otherwise inappropriate words and/or expressions or is offensive in nature or content.
- It allegedly infringes the rights of third parties within the meaning of paragraph 4.7. of this Article.
4.4. Incorrect or incomplete entries will be considered invalid and will not entitle the Participant to any prize; it will be considered that the Participant did not comply with the Rules of the Prize Competition, and the Organiser reserves the right to disqualify such Participant from the Competition at any time.
4.5. The Organiser is authorised at its discretion to remove any Comment or disqualify any Participant, including a Winner, if they act contrary to applicable legal regulations, these Rules, and/or generally accepted ethical norms or harm the Organiser’s reputation or interests. This includes, but is not limited to, suspected fraudulent behaviour by the Participant or Winner or if the Organiser receives a notification or request from third parties regarding the violation of their rights due to any Comment submitted by the Participant.
4.6. The Organiser is not liable for ordinary negligence.
4.7. If a third party files a claim with the Organiser alleging that a specific Comment of a Participant infringes their rights, especially personal rights, including privacy rights or intellectual property rights, the Participant shall indemnify the Organiser for any damages, including fines, awarded compensation, and/or costs of legal proceedings or legal representation incurred due to such claims.
Article 5: Prize Fund, Winner Selection, and Prize
5.1. The total prize fund is valued at 500.00 EUR.
5.2. Winners will be selected by a panel of three Organiser’s employees. The panel will select three (3) most creative entries to receive the Prize.
5.3. At the end of the Prize Competition, the Organiser will select a total of three Comments from Facebook and Instagram which are deemed the most creative pasta dish recipe inspired by a favourite Croatian national team footballer (hereinafter: Winner/s).
5.4. Each Winner will receive one Croatia 2024 away jersey and a Marodi package (hereinafter: Prize/s).
5.5. Each Winner is eligible to receive only one Prize.
5.6. The Winner is not entitled to request another prize or a Prize in a larger quantity than provided by these Rules. The Prize is non-transferable and cannot be exchanged for cash.
Article 6: Prize Notification and Collection
6.1. The Organiser will inform the Winner of the Prize by publicly replying to the winning Comment within five (5) days of the end of the Prize Competition, inviting the Winner to contact the Organiser within the next two (2) days via the official Marodi Facebook inbox or Instagram DM, after which the Organiser will provide all necessary details for Prize collection. Otherwise, it will be assumed that the Winner has forfeited the Prize.
6.2. The Prize will be delivered to the address provided by the Winner to the Organiser. When collecting the Prize, the Winner is required to confirm their identity by presenting a valid photo ID.
6.3. The Organiser's obligations towards the Winner cease upon Prize handover.
Article 7: Intellectual Property Rights
7.1. The content and all parts of the Organiser’s website, as well as its Facebook and Instagram profiles (hereinafter: Materials), may be protected by copyright or other intellectual property rights. All such rights are reserved by the Organiser and any other right holders. The Materials are accessible for viewing and personal, non-commercial use, but their downloading, reproduction (copying), publication, distribution, or any other use for commercial purposes, in whole or in part, is not permitted without the Organiser's prior express consent.
7.2. By submitting their Comment to the Prize Competition, each Participant guarantees that they have all rights to the Comment, including copyright, and that they are authorised to grant these rights to the Organiser in accordance with the provisions of this paragraph. Each Participant retains all rights to their Comment(s) submitted to the Prize Competition. By submitting their Comment to the Prize Competition, the Participant grants the Organiser a non-exclusive, unrestricted right to use the Comment in any manner exclusively for the purposes of organising, conducting, and executing this Prize Competition, without any additional permission or remuneration.
Article 8: Processing and Protection of Personal Data
8.1. The Organiser is the data controller of the Participants' and Winners' Personal Data (as defined in paragraph 8.2 of this Article). Participants and Winners may address any questions, comments, requests, objections, or other remarks regarding their Personal Data processing via email at: marodi@marodi.hr.
8.2. The Organiser processes the following personal data (hereinafter: Personal Data) for the purposes of organising, conducting, and executing the Prize Competition:
(a) Regarding Participants: name and surname or nickname used for their Facebook/Instagram profile from which the Comment was submitted – for the purpose of participating in the Prize Competition;
(b) Regarding Winners: in addition to the Personal Data from sub-item (c) of this paragraph, name, surname, address, and mobile phone number – for the purpose of Prize collection; and
(c) Regarding Winners: name and surname or nickname used for their Facebook/Instagram profile from which the Comment was submitted – for the purpose of informing the public and ensuring the transparency of the Prize Competition as per Article 6, paragraph 1 of these Rules.
8.3. The legal basis for the processing of Personal Data from paragraph 8.2 of this Article (except for data in sub-item (c)) is the Organiser’s fulfilment of obligations towards Participants and Winners under this Prize Competition as per Article 6, paragraph 1, point (b) of the General Data Protection Regulation (EU) 2016/679 (GDPR), and thus for the purpose of organising, conducting, and executing the Prize Competition. Providing this Personal Data is obligatory, as it is necessary for the Participant’s entry or the Winner’s Prize collection. The legal basis for processing Personal Data from paragraph 8.2, sub-item (c) of this Article is the Organiser’s legitimate interest in ensuring the transparency of the Prize Competition, as per Article 6, paragraph 1, point (f) of GDPR.
8.4. Participants' and Winners’ Personal Data may be made available to the following categories of recipients (hereinafter: Recipients) for use in purposes compatible with the Purposes specified in paragraph 8.2 of this Article:
- Data processors assisting the Organiser in organising, conducting, and executing the Prize Competition (such as advertising and marketing agencies, courier services, etc.);
- Competent authorities as required by law.
8.5. The Organiser will process Participants' and Winners' Personal Data for the Purposes specified in paragraph 8.2 of this Article during the duration of the Prize Competition and for up to ten (10) business days after its end, after which the Personal Data will be permanently deleted. The Organiser may keep the Winners’ data from paragraph 8.2, sub-item (c) within the appropriate business records for a period of up to six (6) years unless a longer period is required by applicable legal regulations.
8.6. The rights of Participants and Winners regarding the processing of their Personal Data include:
(a) The right to access their Personal Data and obtain confirmation from the Organiser on whether Personal Data is being processed, and, if so, to access their Personal Data, including the right to receive a copy of processed Personal Data; (b) The right to correct any inaccurate Personal Data without undue delay, including by providing additional statements; (c) The right to delete Personal Data in cases where:
- It is no longer necessary for the Purposes for which it was collected or processed;
- It was unlawfully processed;
- It must be deleted to comply with a legal obligation per applicable legal regulations;
(d) The right to restrict processing in the following cases:
- If the Participant or Winner disputes the accuracy of their Personal Data, for a period allowing the Organiser to verify the Personal Data’s accuracy;
- If processing is unlawful, but the Participant or Winner opposes the deletion of their Personal Data and requests a restriction of its use instead;
- If the Organiser no longer needs Personal Data for processing purposes, but the Participant or Winner requires it for establishing, exercising, or defending legal claims;
(e) The right to lodge a complaint regarding the processing of their Personal Data with the Croatian Personal Data Protection Agency, Selska cesta 136, Zagreb (www.azop.hr).
8.7. The Organiser processes Personal Data securely in accordance with applicable legal regulations and industry standards, implementing appropriate technical, physical, and organisational measures to protect Personal Data against security risks, including unauthorised access, destruction, loss, or disclosure, and to ensure a level of security appropriate to the processing risks.
8.8. Additional information on the Organiser's processing of Personal Data is available in the privacy policy published on https://marodi.com/zastita-osobnih-podataka/.
8.9. Since the Prize Competition takes place on social networks Facebook and Instagram, the processing of personal data by Facebook (including Participants' Personal Data from paragraph 8.2, sub-item (a)) is subject to Facebook's privacy policy and other provisions on personal data processing (e.g., behavioural advertising, including profiling).
Article 9: Cancellation or Suspension of the Prize Competition
9.1. In the event of force majeure or other circumstances beyond the Organiser’s control, the Organiser may cancel or suspend the Prize Competition, notifying all Participants and Winners on the Profile and on the website (https://marodi.com/) as soon as possible under the circumstances.
9.2. In the case referred to in paragraph 9.1 of this Article, the Organiser shall not be liable for any damage to Participants or Winners arising from such cancellation or suspension of the Prize Competition or in connection with it.
Article 10: Dispute Resolution
10.1. The Organiser’s decision on all issues related to the Prize Competition and the application of these Rules is final and binding on all Participants and Winners.
10.2. Any disputes between the Organiser and Participants or Winners regarding the Prize Competition will be subject to the jurisdiction of the competent court in Zagreb.
