A Plate Full of Memories

Article 1: General Provisions
1.1. The organizer of the contest “Marodi – A Plate Full of Memories” (hereinafter: Contest) is Marodi d.o.o., Gospodarska ul. 5, 40305 Nedelišće, OIB: 28972867079 (hereinafter: Organizer).
1.2. The Contest is not a lottery under the provisions of Articles 2 and 3 of the Rules on Organizing Lotteries (Official Gazette 8/2010) in connection with Article 69 of the Law on Games of Chance (Official Gazette 87/2009, 35/2013, 158/2013, 41/2014, 143/2014).
1.3. These contest rules (hereinafter: Rules) will be published and accessible through a link provided in the invitation to participate in the Contest, available on the official Marodi profile on Facebook (facebook.com/maroditjestenina), the description of the official Marodi Instagram profile (https://www.instagram.com/marodihr/), and on the website (www.marodi.com) (hereinafter collectively: Profile).
1.4. By entering the Contest, the Participant (as defined in Article 3, paragraph 3.1 of these Rules) fully accepts these Rules.

Article 2: Duration and Purpose of the Contest
2.1. The Contest is organized to promote the Organizer’s products.
2.2. The Contest begins on November 15, 2024, at 6:00 PM and ends on November 24, 2024, at 11:59 PM.

Article 3: Right to Participate
3.1. The Contest is open to all adult natural persons residing in the Republic of Croatia who have an active profile on Facebook (www.facebook.com) or Instagram (www.instagram.com) (hereinafter: Participant/s).
3.2. Employees of the Organizer and their immediate family members (parents, spouses, children, siblings) or anyone involved in organizing the Contest are not allowed to participate.

Article 4: Participation Method
4.1. Participants can join the Contest by commenting on the Organizer’s Contest post on the Profile from November 15, 2024, at 6:00 PM to November 24, 2024, at 11:59 PM. The comment should describe which pasta dish holds sentimental value for their family and the story or anecdote associated with it (hereinafter: Comment/s). Each Participant may submit only one Comment. The six most creative responses—three on Instagram and three on Facebook—will win the following prizes:

• Two Grand Prizes: The two most creative answers, one from Instagram and one from Facebook, will each win a book from the “Stories Worth Every Letter” collection and a Marodi pasta package.
• Four Consolation Prizes: The remaining four most creative answers (two from Instagram and two from Facebook) will each win a Marodi pasta package.
  4.2. All submissions meeting the Contest conditions and received within the Contest period will be considered for the selection of winners.
  4.3. Comments will not be considered if:
• They do not mention a pasta dish with sentimental value and the story or anecdote associated with it.
• They contain offensive or inappropriate words or expressions or are defamatory in nature.
• They allegedly infringe upon the rights of third parties as defined in Article 4, paragraph 4.7.
  4.4. Incorrect or incomplete applications will be deemed invalid and will not qualify for any prize. The Organizer reserves the right to disqualify Participants who do not comply with these Rules.
  4.5. The Organizer may, at its discretion, remove any Comment and disqualify any Participant, including a Winner, if they act contrary to the law, these Rules, or generally accepted ethical norms.

Article 5: Prize Fund, Winner Selection, and Prizes
5.1. The total prize fund is valued at €155.04.
5.2. Winners will be selected by a jury composed of three employees of the Organizer. The jury will choose three (3) of the most creative entries, and the Participants who submitted them will receive a prize.
5.3. At the end of the Contest, the Organizer will select a total of three (3) Comments on Facebook and Instagram deemed the most creative descriptions of which pasta dish holds sentimental value for their family and the story or anecdote associated with it (hereinafter: Winner/s).
5.4. Each Winner will receive one book from the “Stories Worth Every Letter” collection and a package of Marodi pasta (hereinafter: Prize/s).
5.5. A Winner can receive only one Prize.
5.6. The Winner has no right to request a different prize or a larger quantity of the Prize as provided in these Rules. The Prize is non-transferable and cannot be exchanged for cash.

Article 6: Prize Notification and Collection
6.1. The Organizer will notify the Winner about their Prize in a public reply to their winning Comment within five (5) days after the Contest ends and invite the Winner to contact the Organizer within two (2) days via the official Marodi Facebook inbox or Instagram DM. The Organizer will provide all details regarding the Prize collection in direct communication. Otherwise, it will be considered that the Winner has forfeited their right to the Prize.
6.2. The Prize will be delivered to the address specified by the Winner to the Organizer. The Winner must confirm their identity by presenting a valid photo ID upon Prize collection.
6.3. All obligations of the Organizer toward the Winner cease upon the Prize transfer.

Article 7: Intellectual Property Rights
7.1. The content and all parts of the Organizer's website and the Organizer’s Facebook and Instagram profiles (hereinafter: Materials) may be protected by copyright or other intellectual property rights. Such rights are fully reserved by the Organizer and other potential rights holders. The Materials are available for viewing and non-commercial use but cannot be downloaded, reproduced, published, distributed, or used for commercial purposes without the Organizer's prior express consent.
7.2. By submitting a Comment to the Contest, each Participant guarantees they hold all rights to the Comment, particularly copyright, and that they are authorized to transfer these rights to the Organizer as stipulated in this section. The Participant retains all rights to their Comment/s submitted to the Contest. However, by submitting a Comment, the Participant grants the Organizer a non-exclusive, unlimited, and free right to use the Comment in any way solely for the purpose of organizing, conducting, and implementing this Contest.

Article 8: Processing and Protection of Personal Data
8.1. The Organizer is the data controller for the Participants' and Winners' personal data (hereinafter: Personal Data) as defined in paragraph 8.2 of this Article.
8.2. The Organizer processes the following Personal Data for the purpose of organizing, conducting, and implementing the Contest:
(a) For Participants: name and surname or username under which their Facebook/Instagram profile is registered (for participating in the Contest).
(b) For Winners: name, surname, address, and mobile phone number (for Prize delivery).
(c) For Winners: name and surname or username for public announcement and transparency of the Contest.
8.3. Personal Data will be processed according to GDPR and used for the purposes stated in these Rules. Providing such data is mandatory for Contest participation or Prize collection.

Article 9: Contest Cancellation or Suspension
9.1. In the event of force majeure or unforeseen circumstances, the Organizer may cancel or suspend the Contest, informing Participants and Winners on the Profile and the website (https://marodi.com/) as soon as possible.
9.2. The Organizer is not responsible for any damages caused by the Contest's cancellation or suspension.

Article 10: Dispute Resolution

10.1. The Organizer's decisions on all matters related to the Contest and the application of these Rules are final and binding on all Participants and Winners.
10.2. Any disputes between the Organizer and Participants/Winners will be resolved by the competent court in Zagreb.
